Terms of service

Last Updated: 18th July 2026

SECTION 0 – OVERVIEW

Welcome to CamGuard Australia! The terms "we", "us" and "our" refer to CamGuard Australia, an Australian-based online retailer of genuine security camera products and accessories. CamGuard Australia operates this website (camguardaustralia.com.au), including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). CamGuard Australia is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. Nothing in these Terms is intended to exclude, restrict, or modify rights that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian, and you confirm that your parent or legal guardian has consented to your use of the Services. If you use the Services on behalf of a business, you represent and warrant that you are authorised to act on its behalf and to bind it to these Terms, and "you" includes that business.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

Electronic communications. By using the Services or placing an order, you consent to receive communications from us electronically (including order confirmations, shipping notifications, and notices relating to these Terms) at the email address you provide. A notice is taken to be received when sent to that address. You are responsible for keeping your contact details current.

SECTION 2 – OUR PRODUCTS

CamGuard Australia sells genuine, brand-name security products including (but not limited to) eufy and Ring branded cameras, doorbells, and accessories. Many of our products are parallel imports – meaning they are genuine, original products sourced from authorised international suppliers and imported into Australia. Parallel importing is completely legal under Australian law.

Because our products are parallel imports, they may include US-style power adapters. Where applicable, we include an Australian RCM-certified power adapter at no extra charge. Product listings will clearly state what is included in the box.

We clearly label the condition of all products in our listings. Common condition labels include:

(a) "Brand New & Factory Sealed" – The product is sealed in its original manufacturer packaging and has never been opened.

(b) "New – No Box" – The product is brand new and unused but does not come in its original retail packaging. This often means a better price and less packaging waste.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use and your device settings.

We review the reliability profile of every product before listing it. We don't sell lemons – if a product has known reliability issues, we won't list it. We strongly recommend verifying the specific contents of each listing before purchasing, as included accessories may vary.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

Installation and safe use. Our products are designed for customer installation in accordance with the manufacturer's instructions. You are responsible for installing and mounting products safely and appropriately for your property. Some products (for example, hardwired floodlight cameras or doorbells requiring transformer or mains connection) must be installed by a licensed electrician under Australian law – where a listing or manual indicates hardwiring, do not attempt mains electrical work yourself. CamGuard Australia is not liable for damage or injury arising from improper installation, to the extent permitted by law.

Lawful use of surveillance products. Security cameras, doorbells and related products must be used in accordance with applicable Australian laws, including state and territory surveillance devices and privacy legislation. You are solely responsible for where you install cameras, what they record (including audio, where regulated), and how recordings are used. CamGuard Australia is not responsible for any unlawful use of products purchased from us.

Security products are aids, not guarantees. No security product can guarantee the prevention or detection of theft, damage, intrusion or other loss, and recordings can be affected by positioning, connectivity, power, lighting and other factors. Smart-detection and AI features (such as person, pet or vehicle detection and related alerts) are provided by the manufacturer, are probabilistic in nature, and may miss events or produce false alerts; they are conveniences, not guarantees of detection. To the extent permitted by law, CamGuard Australia is not liable for loss, damage or theft claimed to result from a product failing to deter, detect or record an event. Nothing in this paragraph affects your Australian Consumer Law rights in relation to the quality of the product itself.

Manufacturer apps, accounts and cloud services. Our products typically require the manufacturer's app and account (e.g. the eufy Security app) and may rely on the manufacturer's cloud services, servers, firmware and optional paid subscriptions. These services are provided and controlled solely by the manufacturer, not by CamGuard Australia. The manufacturer may change, limit, charge for, or discontinue app features, cloud storage, integrations or services at any time – this is outside our control, and to the extent permitted by law we are not liable for such changes. This does not affect your rights in relation to the quality of the physical product we sold you, and if a manufacturer-side change materially affects your product within our warranty period, contact us and we will work with you on a fair outcome.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Payment is taken at the time you place your order, and our order confirmation email acknowledges that we have received your order and payment – it is not acceptance of your offer. We accept your offer, and a binding contract for the product(s) in your order is formed, only when we dispatch those product(s) to you and send you a shipping confirmation.

CamGuard Australia reserves the right to decline your order, in whole or in part, at any time before dispatch – including where a product is unavailable, where we identify a pricing, description or other listing error (see Section 13), or where an order does not pass our verification and fraud-prevention checks. If we decline, change or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made, and we will promptly refund in full all amounts paid for any product we do not supply.

If you wish to change or cancel an order, please contact us as soon as possible. We can usually accommodate requests made before dispatch. Once an order has been dispatched it cannot be cancelled, and any return is handled under our Returns & Refund Policy and your rights under the Australian Consumer Law.

Your purchases are subject to return or exchange in accordance with our Returns & Refund Policy and your rights under Australian Consumer Law.

Products sold by CamGuard Australia are intended for personal and household use within Australia. Commercial resale or re-export of our products without our written consent is not permitted.

Availability. All orders are subject to stock availability. If a product you have ordered is unavailable or cannot be supplied within a reasonable time, we will contact you and offer an alternative product, a backorder where possible, or a prompt full refund of the amount paid for that product.

Verification and fraud prevention. We may screen orders and, where reasonably necessary, ask you to verify your identity, payment method or delivery address before dispatch. We may cancel and refund any order we reasonably suspect to be fraudulent, placed by automated means, or made in breach of these Terms.

eBay purchases. Purchases made through our eBay store are additionally subject to eBay's User Agreement and the terms shown on the relevant listing. Our Returns & Refund Policy and 12-Month CamGuard Warranty apply to eBay purchases alongside those terms.

SECTION 4 – PRICES, GST AND BILLING

All prices displayed on our store are in Australian Dollars (AUD) and include GST where applicable. CamGuard Australia is registered for GST (ABN: 62 385 894 763).

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices include GST but may not include shipping, handling, customs or import charges where applicable.

Prices posted on our website may be different from prices offered on other platforms (such as our eBay store) or by other retailers. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorised to use such payment method for the purchase, (iii) charges incurred by you will be honoured by your payment provider, and (iv) you will pay charges incurred by you at the posted prices, including shipping charges and all applicable taxes, if any.

Payment processing. Payments are processed by third-party payment providers (for example Shopify Payments, PayPal and Afterpay). Your use of a third-party payment provider is subject to that provider's own terms and privacy policy. Where you pay using a buy-now-pay-later service such as Afterpay, your instalment arrangement is solely between you and that provider.

Promotions, discount codes and vouchers. Discount codes, vouchers and promotional offers are subject to their stated conditions, cannot be exchanged for cash, apply only within any stated dates and limits, and generally cannot be combined with other offers unless expressly stated. We may withdraw or cancel a promotion at any time, and may cancel orders where a code has been used outside its intended terms (for example, codes generated, shared or applied in error or by automated means).

SECTION 5 – SHIPPING AND DELIVERY

CamGuard Australia ships from Townsville, Queensland, Australia. Most in-stock orders are dispatched within 1 business day of payment confirmation.

Shipping rates, methods, delivery estimates, order changes and address requirements are set out in our Shipping & Delivery Policy, which forms part of these Terms. In summary: orders of $99 and over ship via Australia Post Express free of charge; orders under $99 ship via tracked Standard post for a flat rate, with an Express upgrade available.

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers (e.g. Australia Post), customs processing, weather events, natural disasters, peak-period volumes, or other events outside our reasonable control. Once we transfer products to the carrier, title and risk of loss passes to you, subject to your rights under the Australian Consumer Law and the terms of our Shipping & Delivery Policy.

Plan installation around delivery, not alongside it. We strongly recommend that you do not book installers, electricians, or other trades – or commit to any time-sensitive arrangements – until your order has arrived and you have tested the products. To the extent permitted by law, CamGuard Australia is not liable for third-party costs or losses arising from delivery delays or product issues, including (without limitation) installer or trade booking fees, call-out or cancellation fees, time taken off work, or other scheduling losses, where such costs were incurred before delivery was completed or could reasonably have been avoided. This paragraph does not exclude, restrict or modify any right you have to compensation for reasonably foreseeable loss under the Australian Consumer Law where a consumer guarantee has not been complied with.

Local pickup in Townsville may be available by arrangement. Please contact us to organise.

SECTION 6 – RETURNS, REFUNDS AND CONSUMER GUARANTEES

Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

12-Month CamGuard Warranty: In addition to your statutory rights, every product we sell is covered by the 12-Month CamGuard Warranty – our own warranty against defects, handled entirely by our Australian-based support. Full terms, claim procedure and exclusions are set out in our 12-Month CamGuard Warranty document on this website.

Manufacturer Warranty: As our products are independently imported, they may not be covered by the manufacturer's Australian warranty. Your rights under the Australian Consumer Law are not affected by this, and the 12-Month CamGuard Warranty provides you with local coverage and support in its place.

For full details on returns, refunds, and exchanges, please refer to our Returns & Refund Policy.

Talk to us first. If you have a problem with a product or your order, please contact us at support@camguardaustralia.com.au before pursuing any other avenue – most issues are resolved within one business day, and we're committed to outcomes that a reasonable person would consider fair. Before commencing court proceedings, you and we agree to first attempt in good faith to resolve any dispute by negotiation for up to 30 days from when either of us notifies the other of the dispute in writing. This does not limit your right to contact the Queensland Office of Fair Trading (or your state or territory's fair trading body), the Queensland Civil and Administrative Tribunal (QCAT), or the courts at any time, or any of your rights under the Australian Consumer Law.

SECTION 7 – OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control or input over.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk.

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

CamGuard Australia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with CamGuard Australia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and CamGuard Australia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CamGuard Australia.

SECTION 10 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by CamGuard Australia, its affiliates or licensors and are protected by Australian and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a licence or other rights to you under any patent, trademark, copyright, or other intellectual property of CamGuard Australia, Shopify or any third party. Unauthorised use of the Services may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by CamGuard Australia.

CamGuard Australia's names, logos, product and service names, designs, and slogans are trademarks of CamGuard Australia or its affiliates or licensors. You must not use such trademarks without the prior written permission of CamGuard Australia. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. eufy, Ring, and all other brand names, logos, and product names mentioned on the Services are the trademarks of their respective owners and are used for product identification purposes only.

SECTION 11 – PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed on our website, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

We comply with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth) in relation to the handling of personal information.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide services to you. Review our Privacy Policy for more details on how we, Shopify, and our partners use your personal information.

SECTION 12 – FEEDBACK AND REVIEWS

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this licence to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.

You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary right. You further agree that your Feedback will not contain unlawful, abusive or obscene content, or contain any malware that could affect the operation of the Services. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third party.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 14 – PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:

(a) For any unlawful or malicious purpose

(b) To violate any Australian federal, state, or territory law, or any international law or regulation

(c) To infringe upon or violate our intellectual property rights or the intellectual property rights of others

(d) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person

(e) To transmit false or misleading information

(f) To send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms

(g) To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation

(h) To impersonate or attempt to impersonate any other person or entity

(i) To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm CamGuard Australia, Shopify or users of the Services, or expose them to liability

(j) To exploit an obvious pricing or listing error, place fictitious orders, use automated tools to place orders, or circumvent any purchase limit, promotion condition or other restriction we impose

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or circumvent the security features of the Services or any related website.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 15 – TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply following any termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

EXCEPT AS EXPRESSLY STATED BY CAMGUARD AUSTRALIA, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Important – Australian Consumer Law: This disclaimer does not apply to the extent that it would exclude, restrict, or modify consumer guarantees under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. Where our liability cannot be excluded, it is limited (where permitted by law) to the resupply of the goods or services, or the cost of having the goods or services resupplied.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by Australian law, in no case shall CamGuard Australia, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, installation, trade or call-out fees, booking or cancellation charges, costs of time off work, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any products procured using the Services, or for any other claim related in any way to your use of the Services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Services or any content (or product) posted, transmitted, or otherwise made available via the Services, even if advised of their possibility.

Cap on liability. To the extent permitted by law, and except for liability that cannot be excluded or limited under the Australian Consumer Law, our total aggregate liability to you arising out of or in connection with these Terms, the Services, or any product, whether in contract, tort (including negligence), statute or otherwise, is limited to the total amount you paid us for the product(s) or services giving rise to the claim.

Important – Australian Consumer Law: This limitation of liability does not apply to the extent that it would limit or exclude liability under the Australian Consumer Law that cannot be limited or excluded by agreement, including liability in relation to consumer guarantees.

Events beyond our control. We are not liable for any delay or failure to perform our obligations under these Terms where the delay or failure arises from events beyond our reasonable control, including natural disasters, severe weather, epidemics, industrial action, carrier or postal disruption, utility or telecommunications failures, or actions of government. Our obligations are suspended for the duration of such an event, and we will take reasonable steps to minimise the impact on your order. Nothing in this paragraph affects your right to a refund where products cannot be supplied within a reasonable time.

SECTION 18 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless CamGuard Australia, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party to the extent due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law (including surveillance devices and privacy legislation) or the rights of a third party, (3) any content you submit through the Services (including Feedback), or (4) your misuse of a product purchased from us in a manner contrary to its documentation, safety instructions or intended use.

Exclusions. This indemnity does not apply to the extent that a claim arises from: (a) our breach of these Terms; (b) our negligence or wilful misconduct; or (c) our violation of applicable law. It also does not apply to any matter for which an indemnity from a consumer is prohibited by law, and nothing in this section excludes, restricts or modifies your rights under the Australian Consumer Law.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defence and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defence of indemnified claims, including by providing relevant documents.

SECTION 19 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 21 – ASSIGNMENT

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

SECTION 22 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia. You and CamGuard Australia consent to the exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from those courts.

Nothing in these Terms limits your rights to bring proceedings in another jurisdiction if required by law, including under the Australian Consumer Law.

SECTION 23 – HEADINGS

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 24 – CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
